MedTech Europe’s contribution to the public consultation on Civil liability – adapting liability rules to the digital age and artificial intelligence

In January 2022, MedTech Europe provided input to the EC public consultation on the proposed revision of the product liability framework consisting of the Product Liability Directive 85/374/EEC and national liability rules.

The public consultation covers issues, such as:

• Confirm whether the Product Liability Directive is fit for purpose in relation to AI-driven products
• Address specific challenges that AI poses for liability rules
• Harmonisation of the rules for the development, placing on the market and use of certain AI systems
• Further changes to safety legislation
